These Terms of Service ("Terms") govern your access to and use of the website, services, and bookings provided by Sol Senior Services Inc. By using our website or booking our services, you agree to these Terms. If you do not agree, please do not use the website or book our services.

"You" or "Client" means the person booking or receiving services, or a person legally authorized to act on their behalf (such as a family member, power of attorney, or substitute decision-maker).

Specific services, scope, scheduling, and pricing will be confirmed in a separate written quote, work order, or service agreement provided to you before work begins. The website is for informational purposes and to request bookings only.
Submitting a booking request through our website does not create a binding contract. A booking is only confirmed once we provide written confirmation (by email or otherwise) of the date, scope of work, and price.
We reserve the right to decline or cancel any booking request at our discretion, including where the requested services are outside our service area or capability, the work would pose a safety risk, we cannot verify the requestor's authority to book on behalf of a senior, or we are unable to schedule the requested date.
If you are booking services on behalf of a senior (e.g., as a family member, attorney, or substitute decision-maker), you represent that you have the legal authority to do so and that the senior consents to the services being provided, where required.
Pricing is provided in writing through a quote or service agreement and may be based on hourly rates, flat fees, or a combination, depending on the service. Quotes are valid for the period stated on the quote.
Payment terms (method, deposit, timing) will be set out in your service agreement or invoice. The website does not process payments. All payments are handled separately through invoicing or in-person arrangements.
Additional charges may apply for work that exceeds the scope of the original quote, including extra time, additional items, stairs, long carries, disposal fees, or hazardous-material handling. We will, where reasonably possible, advise you of any anticipated additional charges before proceeding.

Unless expressly agreed in writing in your service agreement, we will not pack, move, store, or dispose of:
"Items of Extraordinary Value" include (but are not limited to) cash, jewellery, precious metals and stones, watches, original artwork, antiques, collectibles, irreplaceable photographs, original documents (passports, wills, deeds, certificates), and digital storage devices containing irreplaceable data.
You are responsible for identifying, securing, and transporting Items of Extraordinary Value yourself. We strongly recommend that you remove these items from the premises or place them in a clearly marked, locked container before our team arrives. To the maximum extent permitted by law, we are not liable for loss of or damage to Items of Extraordinary Value unless their nature and value were disclosed to us in writing in advance and we expressly agreed in writing to handle them.
We maintain commercial liability and cargo/contents insurance appropriate to our services. Details and coverage limits are available on request.
To the maximum extent permitted by applicable Manitoba law:
Any claim for loss or damage must be reported to us in writing within seven (7) days of the date of service. Failure to report a claim within this period may, at our discretion, result in the claim being denied.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable Manitoba law, including under the Consumer Protection Act (Manitoba) or other consumer protection legislation.
You agree to use the website only for lawful purposes and not to submit false or fraudulent booking requests, interfere with the operation or security of the website, use automated tools to scrape or harvest content, or infringe our intellectual property.
All content on the website (text, graphics, logos, images) is owned by Sol Senior Services Inc. or its licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, or use it without our written permission, except for personal, non-commercial use.
We collect and use personal information in accordance with our Privacy Policy and with applicable Canadian privacy laws, including PIPEDA.
The website may contain links to third-party websites or services. We do not control or endorse those sites and are not responsible for their content, policies, or practices. Your use of third-party sites is at your own risk.
You agree to indemnify and hold harmless Sol Senior Services Inc., its owners, employees, contractors, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your failure to disclose hazardous conditions or Items of Extraordinary Value, your lack of authority to book services on behalf of another person, or your violation of any law or third-party right.
We may update these Terms from time to time. The updated version will be posted on the website with a new Effective Date. Your continued use of the website or booking of services after changes are posted constitutes acceptance of the updated Terms. For active bookings, the Terms in effect at the time of booking confirmation will apply.
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable in Manitoba. The parties will first attempt to resolve any dispute through good-faith discussion. If a dispute cannot be resolved informally, the courts of Manitoba, located in Winnipeg, have exclusive jurisdiction.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Entire Agreement. These Terms, together with your service agreement and our Privacy Policy, form the entire agreement between you and us regarding use of the website and the services.
Assignment. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a sale or reorganization of our business.
